Art. 2 Leggi 2 Read Article

La formazione delle leggi e l'emanazione degli atti del Governo aventi forza di legge sono disciplinate da leggi di carattere costituzionale. The formation of laws and the enactment of the acts of the government having the force of law are governed by laws of a constitutional nature. (Cost. 70 e seguenti, 117, 118). Art. 3 Regolamenti Article 3 Regulations

Il potere regolamentare del Governo è disciplinato da leggi di carattere costituzionale (prel Cod. Civ. 4; art. 17, legge 23 agosto 1988, n. 400). Regulatory power of government is governed by the laws of a constitutional nature (prel Code Civ. 4; art. 17 Law of 23 August 1988, n. 400).

Il potere regolamentare di altre autorità è esercitato nei limiti delle rispettive competenze, in conformità delle leggi particolari (prel Cod. Civ. 4; art. 5, legge 8 giugno 1990, n. 142). Regulatory power of other authority is exercised within the limits of their competence, in accordance with the particular laws (prel Code Civ. 4, art. 5 of 8 June 1990, n. 142).

Art. 4 Limiti della disciplina regolamentari Article 4 Limits of the discipline regulations

I regolamenti (prel Cod. Civ. 3) non possono contenere norme contrarie alle disposizioni delle leggi. Regulations (prel Code Civ. 3) not contain provisions contrary to the provisions of the laws.

Art. 8 Usi Article 8 Use

Nelle materie regolate dalle leggi e dai regolamenti gli usi hanno efficacia solo in quanto sono da essi richiamati (Cod. Nav. 1). In matters governed by the laws and regulations are applicable only uses as they are called in (Cod Nav. 1).

Art. 10 Inizio dell'obbligatorietà delle leggi e dei regolamenti Top 10 Art mandatory laws and regulations

Le leggi ei regolamenti divengono obbligatori nel decimoquinto giorno successivo a quello della loro pubblicazione, salvo che sia altrimenti disposto (Cost. 73, 3° comma) (*). The laws and regulations become mandatory in the fifteenth day following the date of their publication, except as otherwise provided (Const. 73, 3rd paragraph) (*).

Art. 11 Efficacia della legge nel tempo Article 11 Application of the law in time

La legge non dispone che per l'avvenire: essa non ha effetto retroattivo (Cost. 25). The law does not provide that for the future: it has no retroactive effect (Const. 25).

I contratti collettivi di lavoro (Cod. Civ. 2067 e seguenti) possono stabilire per la loro efficacia una data anteriore alla pubblicazione, purché non preceda quella della stipulazione. The collective bargaining agreements (Code Civ. 2067 et seq) may determine their effectiveness for a date prior to publication, provided no earlier than the conclusion.

Art. 12 Interpretazione della legge Article 12 Interpretation of Law

Nell'applicare la legge non si può ad essa attribuire altro senso che quello fatto palese dal significato proprio delle parole secondo la connessione di esse, e dalla intenzione del legislatore. Art. 14 Applicazione delle leggi penali ed eccezionali Article 14 Enforcement of criminal laws and exceptional

Le leggi penali e quelle che fanno eccezione a regole generali o ad altre leggi non si applicano oltre i casi ei tempi in esse considerati (Cost. 25; Cod. Pen. 2). Criminal laws and those that are exceptions to general rules or other laws do not apply beyond the circumstances and times when they considered (Const. 25; Cod Pen. 2).

Art. 15 Abrogazione delle leggi Article 15 Repeal of laws

Le leggi non sono abrogate che da leggi posteriori per dichiarazione espressa del legislatore, o per incompatibilità tra le nuove disposizioni e le precedenti o perché la nuova legge regola l'intera materia già regolata dalla legge anteriore. Art. 16 Trattamento dello straniero Article 16 Treatment of foreign

Lo straniero è ammesso a godere dei diritti civili attribuiti al cittadino a condizione di reciprocità e salve le disposizioni contenute in leggi speciali (*). Questa disposizione vale anche per le persone giuridiche straniere (Cost. 10; Cod. Civ. 2505). This provision also applies to foreign legal persons (Const. 10; Code Civ. 2505).

Art. 17 Legge regolatrice dello stato e della capacità delle persone e dei rapporti di famiglia Article 17 Governing Law of the state and capacity of individuals and family relationships

Lo stato e la capacità delle persone ei rapporti di famiglia sono regolati dalla legge dello Stato al quale esse appartengono. The status and capacity of persons and family relations are governed by State law to which they belong.

Tuttavia uno straniero, se compie nella Repubblica un atto per il quale sia incapace secondo la sua legge nazionale, è considerato capace se per tale atto secondo la legge italiana sia capace il cittadino, salvo che si tratti di rapporti di famiglia, di successioni per causa di morte, di donazioni, ovvero di atti di disposizioni di immobili situati all'estero. However, a foreigner, if he carries out an act in the Republic for which it is incapable in accordance with its national law, is considered capable if the act under Italian law is capable citizens, except in case of family relations, succession due to death, donations, or to dispositions of property situated abroad.

Art. 18 Legge regolatrice dei rapporti personali tra coniugi Article 18 Governing Law of personal relations between spouses

I rapporti personali tra coniugi di diversa cittadinanza sono regolati dall'ultima legge nazionale che sia stata loro comune durante il matrimonio o, in mancanza di essa, dalla legge nazionale del marito al tempo della celebrazione del matrimonio. The personal relations between spouses of different nationalities have settled since the last national law that was common during their marriage or, failing that, by the national law of the husband at the time of the marriage.

Art. 19 Legge regolatrice dei rapporti patrimoniali tra coniugi Article 19 of the Law regulating property relations between spouses

I rapporti patrimoniali tra coniugi sono regolati dalla legge nazionale del marito al tempo della celebrazione del matrimonio. Property relationships between spouses are governed by national law of the husband at the time of the marriage.

Il cambiamento di cittadinanza dei coniugi non influisce sui rapporti patrimoniali, salve le convenzioni tra i coniugi in base alla nuova legge nazionale comune. The change of nationality of the spouses has no effect on property relations, subject to agreements between spouses under the new common national law.

Art. 20 Legge regolatrice dei rapporti tra genitori e figli Article 20 Governing Law of the relationship between parents and children

I rapporti tra genitori e figli sono regolati dalla legge nazionale del padre, ovvero da quella della madre se soltanto la maternità è accertata o se soltanto la madre ha legittimato il figlio. The relationship between parents and children are governed by national law of the father, or that if only the mother's pregnancy is detected or if only the mother has legitimized the child.

I rapporti tra adottante e adottato sono regolati dalla legge nazionale dell'adottante al tempo dell'adozione. The relationship between adopter and adopted shall be governed by national law of the adopter at the time of its adoption.

Art. 21 Legge regolatrice della tutela Article 21 Governing Law Protection

La tutela e gli altri istituti di protezione degli incapaci sono regolati dalla legge nazionale dell'incapace. The protection and other institutions of protection of incompetents are regulated by national law incapacity.

Art. 22 Legge regolatrice del possesso, della proprietà e degli altri diritti sulle cose Article 22 law governing the possession, ownership and other rights over things

Il possesso, la proprietà e gli altri diritti sulle cose mobili e immobili sono regolati dalla legge del luogo nel quale le cose si trovano. Possession, ownership and other rights on movable and immovable property are governed by the law of the place where things are located.

Art. 23 Legge regolatrice delle successioni per causa di morte Article 23 Governing Law of succession due to death

Le successioni per causa di morte sono regolate, ovunque siano i beni, dalla legge dello Stato al quale apparteneva, al momento della morte, la persona della cui eredita si tratta. Succession due to death are governed, wherever the goods, the law of the State to which he belonged, at the time of death, the person whose legacy it is.

Art. 24 Legge regolatrice delle donazioni Article 24 Governing Law of donations

Le donazioni sono regolate dalla legge nazionale del donante. The donations are governed by national law of the donor.

Art. 25 Legge regolatrice delle obbligazioni Article 25 Governing Law of Obligations

Le obbligazioni che nascono da contratto sono regolate dalla legge nazionale dei contraenti, se è comune; altrimenti da quella del luogo nel quale il contratto è stato conchiuso. E' salva in ogni caso la diversa volontà delle parti. E 'except in any case the different intention of the parties.

Art. 26 Legge regolatrice della forma degli atti Governing Law Section 26 of the form of acts

La forma degli atti tra vivi e degli atti di ultima volontà è regolata dalla legge del luogo nel quale l'atto è compiuto o da quella che regola la sostanza dell'atto, ovvero dalla legge nazionale del disponente o da quella dei contraenti, se è comune. Le leggi penali e quelle di polizia e sicurezza pubblica obbligano tutti coloro che si trovano nel territorio dello Stato. Criminal laws and those of police and public safety require all those who are in the state.

Art. 29 Apolidi Article 29 Stateless

Se una persona non ha cittadinanza, si applica la legge del luogo dove risiede in tutti i casi nei quali, secondo le disposizioni che precedono, dovrebbe applicarsi la legge nazionale. Art. 30 Rinvio ad altra legge Article 30 Referral to other law

Quando, ai termini degli articoli precedenti, si deve applicare una legge straniera, si applicano le disposizioni della legge stessa senza tener conto del rinvio da essa fatto ad altra legge. DELLE PERSONE FISICHE OF NATURAL

Art. 1 Capacità giuridica Article 1 Legal status

La capacità giuridica si acquista dal momento della nascita. The legal capacity is acquired from the moment of birth.

I diritti che la legge riconosce a favore del concepito sono subordinati all'evento della nascita (462, 687, 715, 784). The rights that the law recognizes for the conceived event are dependent on the birth (462, 687, 715, 784).

Art. 2 Maggiore età. Article 2 of age. Capacità di agire Capacity to act

La maggiore età è fissata al compimento del diciottesimo anno. Age of majority is fixed to the holder's eighteenth year. Con la maggiore eta si acquista la capacità di compiere tutti gli atti per i quali non sia stabilita una età diversa. By the age when one acquires the capacity to perform all the acts for which there is established a different age.

Sono salve le leggi speciali che stabiliscono un'età inferiore in materia di capacità a prestare il proprio lavoro. Art. 5 Atti di disposizione del proprio corpo Article 5 Acts of disposition of his body

Gli atti di disposizione del proprio corpo sono vietati quando cagionino una diminuzione permanente della integrità fisica, o quando siano altrimenti contrari alla legge, all'ordine pubblico o al buon costume (1418). Art. 6 Diritto al nome Article 6 Right to name

Ogni persona ha diritto al nome che le è per legge attribuito. Everyone has the right to a name that is assigned by law.

Nel nome si comprendono il prenome e il cognome. The name will include the first name and last name.

Non sono ammessi cambiamenti, aggiunte o rettifiche al nome, se non nei casi e con le formalità dalla legge indicati. Are not allowed changes, additions or corrections to the name, except in the cases and with the formalities specified by law.

Art. 7 Tutela del diritto al nome Article 7 Protection of the right to the name

La persona, alla quale si contesti il diritto all'uso del proprio nome o che possa risentire pregiudizio dall'uso che altri indebitamente ne faccia, può chiedere giudizialmente la cessazione del fatto lesivo, salvo il risarcimento dei danni (2563). Nel caso previsto dall'articolo precedente, l'azione può essere promossa anche da chi, pur non portando il nome contestato o indebitamente usato, abbia alla tutela del nome un interesse fondato su ragioni familiari degne d'essere protette. Qualora l'immagine di una persona o dei genitori, del coniuge o dei figli sia stata esposta o pubblicata fuori dei casi in cui l'esposizione o la pubblicazione e dalla legge consentita, ovvero con pregiudizio al decoro o alla reputazione della persona stessa o dei detti congiunti, l'autorità giudiziaria, su richiesta dell'interessato, può disporre che cessi l'abuso, salvo il risarcimento dei danni. Le associazioni, le fondazioni e le altre istituzioni di carattere privato acquistano la personalità giuridica mediante il riconoscimento concesso con decreto del Presidente della Repubblica. Associations, foundations and other institutions of a private nature became a legal entity by the recognition granted by decree of President of the Republic.

Per determinate categorie di enti che esercitano la loro attività nell'ambito della Provincia, il Governo può delegare ai prefetti la facoltà di riconoscerli con loro decreto (att. 1, 2). For certain categories of entities that pursue their activities within the Province, the Government may delegate to the prefects the power to recognize them with their decree (att. 1, 2).

Art. 13 Società 13 Art Society

Le società sono regolate dalle disposizioni contenute nel libro V (2247 e seguenti). Companies are governed by the provisions contained in Book V (2247 et seq.)

Art. 14 Atto costitutivo Art 14 Constitutive Act

Le associazioni e le fondazioni devono essere costituite con atto pubblico (1350, 2643). Associations and foundations must be established by public deed (1350, 2643).

La fondazione può essere disposta anche con testamento (600). The foundation can also be ordered in his will (600).

Art. 15 Revoca dell'atto costitutivo della fondazione Article 15 Revocation of incorporation of the foundation

L'atto di fondazione può essere revocato dal fondatore fino a quando non sia intervenuto il riconoscimento, ovvero il fondatore non abbia fatto iniziare l'attività dell'opera da lui disposta. The deed of foundation may be revoked by the founder until there has been recognition, or the founder did not commence the activity of what God has prepared.

L'atto costitutivo e lo statuto devono contenere la denominazione dell'ente, l'indicazione dello scopo, del patrimonio e della sede, nonché le norme sull'ordinamento e sulla amministrazione. The memorandum and articles of association must contain the name of the institution, the indication of the purpose, heritage and home, and the rules on the organization and administration. Devono anche determinare, quando trattasi di associazioni, i diritti e gli obblighi degli associati e le condizioni della loro ammissione; e, quando trattasi di fondazioni, i criteri e le modalità di erogazione delle rendite. They must also determine, in the case of associations, the rights and obligations of members and conditions of their admission, and, in the case of foundations, criteria and procedures for payment of annuities.

L'atto costitutivo e lo statuto possono inoltre contenere le norme relative alla estinzione dell'ente e alla devoluzione del patrimonio, e, per le fondazioni, anche quelle relative alla loro trasformazione (28). Le modificazioni dell'atto costitutivo e dello statuto devono essere approvate dall'autorità governativa nelle forme indicate nell' art. The amendments of the Constitution and the statutes must be approved by the government in the forms listed in 'art. 12 (att. 4). 12 (att. 4).

Art. 17 Acquisto di immobili e accettazione di donazioni, eredità e legati Article 17 Purchase of property and acceptance of gifts, inheritances and legacies

La persona giuridica non può acquistare beni immobili, né accettare donazioni o eredita, né conseguire legati senza l'autorizzazione governativa (473, 782; att. 5-7). L'assemblea deve essere inoltre convocata quando se ne ravvisa la necessità o quando ne è fatta richiesta motivata da almeno un decimo degli associati. The assembly must also be convened when they see a need or when they have made a reasoned request from at least one tenth of the members. In quest'ultimo caso, se gli amministratori non vi provvedono, la convocazione può essere ordinata dal Presidente del tribunale (att. 8). In the latter case, if the directors fail to do so, the summons may be ordered by the Presiding Judge (att. 8).

Art. 21 Deliberazioni dell'assemblea Article 21 Resolutions of the

Le deliberazioni dell'assemblea sono prese a maggioranza di voti e con la presenza di almeno la metà degli associati. The deliberations of the Assembly are taken by majority of votes and the presence of at least half of the members. In seconda convocazione la deliberazione è valida qualunque sia il numero degli intervenuti. In the second call resolution is valid whatever the number of respondents. Nelle deliberazioni di approvazione del bilancio e in quelle che riguardano la loro responsabilità gli amministratori non hanno voto. Per modificare l'atto costitutivo o lo statuto, se in essi non è altrimenti disposto, occorrono la presenza di almeno tre quarti degli associati e il voto favorevole della maggioranza dei presenti. Art. 22 Azioni di responsabilità contro gli amministratori Article 22 liability actions against directors

Le azioni di responsabilità contro gli amministratori delle associazioni per fatti da loro compiuti sono deliberate dall'assemblea e sono esercitate dai nuovi amministratori o dai liquidatori (2941). The liability actions against administrators of associations made by their tasks are performed and are resolved by the new directors or liquidators (2941).

Art. 23 Annullamento e sospensione delle deliberazioni Article 23 Cancellation and suspension of the proceedings

Le deliberazioni dell'assemblea contrarie alla legge, all'atto costitutivo o allo statuto possono essere annullate su istanza degli organi dell'ente, di qualunque associato o del pubblico ministero. The decisions of the conflict with the law, with the Constitution or the statutes may be canceled at the request of the organs of the body, any associated or prosecutor.

L'annullamento della deliberazione non pregiudica i diritti acquistati dai terzi di buona fede in base ad atti compiuti in esecuzione della deliberazione medesima (1445, 2377). The annulment of the resolution does not prejudice the rights acquired by third parties of good faith on the basis of acts done in pursuance of that resolution (1445, 2377).

Il Presidente del tribunale o il giudice istruttore, sentiti gli amministratori dell'associazione, può sospendere, su istanza di colui che l'ha proposto l'impugnazione, l'esecuzione della deliberazione impugnata, quando sussistono gravi motivi. The President of the court or the investigating judge, after consultation with the directors of the association, may suspend, at the request of the man who brought the appeal, execution of the contested decision, when there are serious reasons. Il decreto di sospensione deve essere motivato ed è notificato agli amministratori (att. 10). The decree of suspension should be reasoned and notified administrators (att. 10).

L'esecuzione delle deliberazioni contrarie all'ordine pubblico o al buon costume può essere sospesa anche dall'autorità governativa (att. 9). The execution of decisions contrary to public policy or morality may also be suspended by the government (att. 9).

Art. 24 Recesso ed esclusione degli associati Article 24 Withdrawal and exclusion of members

La qualità di associato non è trasmissibile, salvo che la trasmissione sia consentita dall'atto costitutivo o dallo statuto. The quality of association is not transferable, except that the transmission is permitted of incorporation or the bylaws.

L'associato può sempre recedere dall'associazione se non ha assunto l'obbligo di farne parte per un tempo determinato. The member can withdraw from if not always assumed the obligation to serve on it for a specified time. La dichiarazione di recesso deve essere comunicata per iscritto agli amministratori e ha effetto con lo scadere dell'anno in corso, purché sia fatta almeno tre mesi prima. The declaration of withdrawal must be communicated in writing to the directors and takes effect with the expiry of the current year, provided it is done at least three months before.

L'esclusione d'un associato non può essere deliberata dall'assemblea che per gravi motivi; l'associato può ricorrere all'autorità giudiziaria entro sei mesi dal giorno in cui gli è stata notificata la deliberazione. The exclusion of an association can not be resolved by that for serious reasons, the association may appeal to the court within six months from the day it was notified of the decision.

Art. 25 Controllo sull'amministrazione delle fondazioni Article 25 Monitoring the administration of foundations

L'autorità governativa esercita il controllo e la vigilanza sull'amministrazione delle fondazioni; provvede alla nomina e alla sostituzione degli amministratori o dei rappresentanti, quando le disposizioni contenute nell'atto di fondazione non possono attuarsi; annulla, sentiti gli amministratori, con provvedimento definitivo, le deliberazioni contrarie a norme imperative, all'atto di fondazione, all'ordine pubblico o al buon costume; può sciogliere l'amministrazione e nominare un commissario straordinario, qualora gli amministratori non agiscano in conformità dello statuto e dello scopo della fondazione o della legge. The governmental authority exercising control and supervision on the administration of foundations, ensure the appointment and replacement of the directors or representatives, where the provisions contained in the foundation can not be realized; undo, in consultation with administrators, with the final measure its proceedings are contrary to mandatory rules, the act of founding, public order or morality, may dissolve the government and appoint a special commissioner, if administrators do not act in accordance with the statutes and the purpose of the foundation or law.

Le azioni contro gli amministratori per fatti riguardanti la loro responsabilità devono essere autorizzate dall'autorità governativa e sono esercitate dal commissario straordinario, dai liquidatori o dai nuovi amministratori. The actions against the directors for facts relating to their responsibilities should be authorized by the government and is exercised by the special commissioner, the liquidators or the new administrators.
